Elon Musk Tries to Settle OpenAI Lawsuit Days Before Trial, Sends Threatening Message

Just days prior to the commencement of his high-profile trial, Elon Musk made attempts to settle a lawsuit that accuses OpenAI of abandoning its original mission of developing artificial intelligence for the benefit of humanity under the leadership of Sam Altman. A recent court filing from OpenAI revealed that Musk reached out to the company’s President, Greg Brockman, only two days before the trial, seeking to assess interest in a potential resolution.

Brockman suggested that both parties forgo their claims; however, Musk declined this offer. His response took a threatening tone, indicating that the court may permit Brockman to present Musk’s message as evidence, which could imply ulterior motives behind Musk’s legal actions. Musk’s message suggested repercussions for Brockman and Altman, stating, “By the end of this week, you and Sam will be the most hated men in America. If you insist, so it will be.”

As the trial commenced last week with Musk testifying first, he faced challenges on the stand, including several stumbles and concessions that may have undermined his case. His demeanor became increasingly agitated, and he modified earlier claims regarding the potential existential risks of AI. Furthermore, he acknowledged a lack of understanding of AI safety at his own organization, xAI.

Should the court admit Musk’s alleged threat as evidence, it could further complicate his position. Brockman is expected to testify about Musk’s communications, likely during his appearances in the following days. Although communications related to proposed settlements are generally inadmissible, OpenAI referenced a precedent from Musk’s previous legal challenges. In a 2022 case concerning his attempt to back out of acquiring Twitter, Musk’s legal representation introduced the notion of “renegotiation” to avoid litigation, while simultaneously issuing threats designed to exert pressure on Twitter’s leadership.

This unfolding legal drama highlights the intricate dynamics at play, not only within Musk’s relationships and business dealings but also the implications of his actions in the rapidly evolving field of artificial intelligence.
